Terms of service
These terms govern your use of dtdsystems.ch and every order you place with us. Please read them before ordering. By placing an order you accept them.
1. Who you are dealing with

This website is operated by DTD Systems GmbH. Any earlier reference to another trading name on this site is superseded by these terms.
2. Who may buy
You must be at least 18 years old and have legal capacity to contract. Night vision and thermal imaging devices are sold to adults only.
We sell to private customers and to businesses. We do not supply military or state-actor procurement, brokerage, or onward supply to third parties. We may refuse any order at our discretion, and we will refund it in full if we do.
3. Products and descriptions
We describe our products as accurately as we can. Photographs are illustrative. Image intensifier tubes vary between individual units within their specification; where a per-tube data sheet exists we will show it to you on request.
Accessories, mounts and helmets shown alongside a device are not included unless the product page says so.
4. Prices and VAT
Prices are shown in Swiss francs, or in your local currency where we offer it, and include Swiss VAT at 8.1%.
Deliveries to Switzerland and Liechtenstein are charged with Swiss VAT included, as shown.
Deliveries to any other country are exports and are exempt from Swiss VAT. The 8.1% is deducted automatically at checkout, so you pay less than the displayed Swiss price.
Import VAT and customs duty in the destination country are payable by you, normally to the carrier before delivery. They are set by your country and are not included in our prices.
We may change prices at any time. The price that applies to your order is the one displayed when you place it.
5. How a contract is formed
Your order is an offer to buy. A contract comes into existence when we confirm the order by email, or when we dispatch the goods, whichever happens first. An automatic acknowledgement that we have received your order is not an acceptance.
If a price or description is obviously wrong, we may decline the order and refund you in full.
6. Payment
We accept the payment methods shown at checkout. Where instalment or deferred payment is offered by a third-party provider, that provider's own terms apply between you and them.
Devices are not dispatched until payment has cleared and, where required, export clearance has been granted.
7. Where we ship
We ship to Switzerland, Liechtenstein and EU and Schengen countries. We do not ship to Russia, Belarus or any destination covered by Swiss sanctions, and we do not ship controlled devices anywhere outside the list above.
8. Export control and the End User Certificate
Night vision and thermal imaging equipment is controlled under Swiss export control law and administered by SECO.
If your delivery address is outside Switzerland or Liechtenstein, you must sign and return an End User Certificate before we can ship. It confirms who will use the device and that it will not be passed on to anyone else in breach of Swiss export rules. We prepare the paperwork and file the application.
You confirm that the information you give us for that application is true, that you are the end user or are authorised to act for them, and that you will not re-export or transfer the device in breach of Swiss or applicable export law.
If clearance is refused or cannot be obtained for your destination, the contract ends and we refund you in full. We are not liable for any further loss in that situation.

9. Delivery and risk
Delivery times are estimates and run from dispatch. All shipments are insured.
We carry the risk of loss or damage in transit until the goods are delivered to you or to someone you have named to receive them.
Please report transport damage as set out in our shipping policy. That deadline helps us recover from the carrier and does not affect your statutory rights.
10. Right of withdrawal and returns
If you are a consumer resident in the EU or EEA, you may withdraw from the contract within 14 days of receiving the goods, without giving a reason. Tell us by email at info@dtdsystems.ch before the period ends, return the goods within 14 days of telling us, and we will refund the price and standard outbound delivery cost within 14 days of receiving the goods back or proof of return. You bear the cost of return. You are liable for any loss in value caused by handling beyond what is needed to establish the nature and characteristics of the goods.
Swiss law gives no statutory right of withdrawal for online purchases. We nevertheless offer customers in Switzerland and Liechtenstein the same 14-day return window on the same conditions.
Returns from outside Switzerland must be arranged with us in advance, because the goods have to be re-imported and, for controlled devices, the export licence has to be handled correctly. Do not ship anything back without contacting us first.
Custom builds and items modified to your specification cannot be returned unless they are faulty.
11. Guarantee for defects
Goods must match their description and be of the quality you can reasonably expect. If they are not, you are entitled to have them repaired or replaced, and to a price reduction or cancellation where that fails.
This guarantee runs for two years from delivery for all consumers, in Switzerland and in the EU and EEA alike. It does not cover fair wear and tear, accidental damage, misuse, unauthorised modification, or damage caused by exposing an image intensifier tube to bright light in breach of the operating instructions.
Manufacturer warranties, where offered, run alongside this and do not reduce it. Full terms are on our warranty page.
12. Your responsibilities in use
You are responsible for complying with the law where you use the device, including any national rules on the possession or use of night vision and thermal equipment, and on hunting and wildlife observation. Those rules differ from country to country. It is your responsibility to check them.
13. Intellectual property
All content on this site, including text, photographs, video and the DTD Systems and Dusk Till Dawn marks, belongs to us or our suppliers. You may not copy or reuse it commercially without our written permission.
14. Liability
We are liable for damage caused by our intent or gross negligence, for death or personal injury, and wherever mandatory law imposes liability that cannot be excluded. Beyond that, our liability is limited to the value of the order, and we are not liable for indirect or consequential loss.
Nothing in these terms limits the statutory rights of a consumer.
15. Data protection
We handle personal data as described in our privacy policy. Export applications require us to pass end user details to SECO, which is a legal obligation and a condition of supplying controlled goods.
16. Changes to these terms
We may update these terms. The version published when you place your order is the one that applies to it.
17. Governing law and jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Villmergen, Switzerland.
If you are a consumer resident in the EU or EEA, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings there.
